OFFICIAL CONTEST RULES

Reference to Sponsor, Entry, Entrant, Winner defined:

Sponsor: Workers’ Compensation Board of Nova (referred hereafter as the Sponsor). 

Entry: An Entry in the Safety Sticks contest is as follows and will herein be referred to as an Entry. The bottom of the Young Worker Safety Pledge form (the stub) must be read, signed by the young worker and their employer, detached and submitted to the contest by sending via regular mail to Young Worker Pledge Contest c/o Trampoline | 1559 Barrington Street, Suite 200 | B3J 1Z7

Entrant: Any young worker, in partnership with their supervisor/manager (“employer”), who has successfully submitted an Entry. Both must have read, signed and submitted the Young Worker Safety Pledge stub. Both must be employed by the same legally registered business in Nova Scotia (referred hereafter as the Entrant). A “Young worker” is a worker under the age of 24 years, or a student in a full time educational program at the time of entry, that is in the employment (paid or unpaid) of a business legally registered in Nova Scotia.   

Winners: The employer  of  three chosen Entrants. Three(3) workplaces will be selected as Winners; 1 small business (3 to 19 employees), 1 medium size business (51-199 employees), and 1 large size (200 + employees). 

Contest defined:
The Safety Sticks Contest (hereafter referred to as the Contest) provides the Entrant with a chance to win an End-of-summer Celebration* for their workplace. 

*Actual prize awarded for the End-of-summer Celebration will be a gift certificate to a grocery store of the winners choosing from a list of choosen vendors provided by the sponsor  at a value of $250, $500, or $1,000, dependent on the number of company employees, no substitutions for prize awarded. Along with the grocery store gift card, comes the opportunity for the WCB street team to attend this end of summer celebration. Further details will be organized upon identification of prize recipients. 

The  prizes may be awarded based on company size at the time of the awarding of the prize; 

  • 1 - $250 prize for a small business (3 to 19  employees), 
  • 1 - $500 prize for a medium size business (20 to 199 employees),
  • 1 - $1,000 prize for large size business (200 + employees). 

1. CONTEST PERIOD

The Contest commences on April 20, 2015 at 9:01 a.m. A.D.T. and closes on July 31, 2015 at 11:59 p.m. A.D.T. 

2. ELIGIBILITY

a. The Contest is open to legal residents who are employed by a legally registered business of Nova Scotia and shall be construed and evaluated according to Nova Scotia and Canadian law. Do not enter this contest if you are not a legal resident of Canada. No purchase is necessary. This Contest is void where prohibited by law.

b. A winning Entrant who has not reached the age of eighteen (18) as of the date of their entry into the Contest must have the consent of a parent or legal guardian or other responsible adult in order to enter the Contest and must have the parent or legal guardian sign the consent form that will be sent after the winners are contacted, before prizes are awarded. A Winner must be the actual workplace of the chosen Entrant. The workplace must be a business legally registered in Nova Scotia, Canada. 

c. The Contest is not open to WCB employees or their immediate family.

3. HOW TO ENTER

d. No purchase necessary. To Enter the Contest during the Contest Period:

e. Read, sign and appropriately fill out the Young Worker Safety Pledge stub. This must be signed by both the employer and Young Worker. 

f. Mail Entry via Canada Post approved mail outlet. Mail to “Young Worker Pledge Contest” c/o Trampoline | 1559 Barrington Street, Suite 200 | B3J 1Z7

g. Only Entries from Entrants employed by a workplace that is a business legally registered in Nova Scotia, will be considered valid.  Only Entries submitted in accordance with the above steps are eligible and are referred to as an Entry. 

h. Contest opens on April 20, 2015, with any prizes   awarded after contest closes on July 31, 2015. 

i. By participating, Entrants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to this contest. 

j. All Entries, in order to be eligible, must be received on or after 9:00 a.m. A.D.T. on April 20, 2015, and on or before 11:59 p.m. A.D.T. on July 31, 2015 (the “Contest Period”). Any personal information submitted with or contained in an Entry, or elsewhere, will only be used for the purposes of administering this Contest and for no other purpose. 

k. Any Entry that does not meet the above criteria will be deemed void. The Sponsor reserves the right, in its sole discretion, to disqualify, and/or declare void at any time any photo or entry that does not comply with these Official Rules & Regulations.

4. WINNER SELECTION

RANDOM DRAW: All eligible Entries will be included in a random draw to be held on August 5, 2015. 

5. WINNER SELECTION

l. Three Winner(s) will be randomly selected on Wednesday, August 5, 2015 at 9:00 a.m.

m. Once a Winner has been selected, the Sponsor will notify the Winner(s) by contacting the winning Entrant(s) employer via the contact information placed on their winning Entry(s).

n. The winning Entrant(s) employer must respond within 72 hours of notification. If the Sponsor is not contacted by the winning Entrant(s) employer within 72 hours of notification, the Winner(s) will therein forfeit the Prize in its entirety. In such cases, it shall be in the Sponsor’s sole discretion to select a new Winner(s).  

o. Selection of Winner(s) will stop once a Winner(s) employer has contacted the Sponsor and successfully completed the Statement of Eligibility, Release of Liability, and Prize Acceptance. If no winners employer’s contact the Sponsor, it will be at the sole discretion of the Sponsor to stop selecting winners and forfeit the awarding of any Prize.

6. PRIZING

p. Three(3) prizes may be  be awarded for the Contest period. Prizes will be awarded based on company size; One(1) $250 prize for a small business (3 to 19  employees), One(1) $500 prize for a medium size business (20 to 199  employees), and One(1) $1,000 prize for large size business (200 +  employees). No substitutions will be granted for these prizes. 

q. Along with any prize awarded, comes the opportunity for the WCB street team to attend this end of summer celebration. Further details to be organized upon identification of prize recipients. 

r. Prizes are not transferable and cannot be assigned, redeemed for cash, exchanged nor substituted except where indicated, but the Sponsor reserves the right to substitute prize with one of equal or greater value if the prize becomes unavailable for any reason, and, accepted as offered. If a prize is unable to be used for any reason, entrants agree that it will be returned to the WCB for awarding to another entrant.

s. Delivery of Prize(s): Following receipt of the selected Entrant’s signed declaration and release form, the Sponsor or its representatives will send the prizes to the Winners employers. Please allow ten (10) business days for delivery.

7. GENERAL SPECIFICATIONS

t. Contest Entries become property of the Sponsor upon receipt and will not be returned and no correspondence will be entered into except with selected Entrants.

u. Any Entry, which is the sole opinion of the Sponsor, that is deemed inappropriate, is ineligible.

v. Entrant represents that, at the time of Entry, Entrant is the sole owner of all ownership rights, title and interest, copyright and other intellectual property (including moral rights) in Entry. By submitting an Entry, Entrant relinquishes all ownership rights, title and interest and copyright and other intellectual property rights in Entry to the Sponsor, such the Sponsor obtains all such rights, and Entrant waives all moral rights therein. If at any time the Entry is discovered to have been copied or plagiarized or if it otherwise infringes upon any of the rights outlined in these Official Rules and Regulations, the Entrant, and not the Sponsor, will be solely responsible for any legal ramifications resulting from such breach or infringement and the Entrant will indemnify and save Contest Entities, their affiliates, agents and employees harmless from and against all such claims.

w. By participating in this Contest, Entrants (and if entrant is a minor, Entrant’s parents or legal guardians) accept all risk and consequences of Entry and participation in this Contest, and agree to release and hold the Sponsor, its officers, directors, affiliates, employees, contractors, subsidiaries, agents and partners harmless from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to this Contest, including but limited to the Entrant’s Entry and participation in this Contest, the acceptance and/or use (or misuse) of any prize, printing errors, any claims based upon rights of publicity and invasion of privacy. Entrant shall indemnify the Sponsor, its officers, directors, affiliates, contractors, subsidiaries, agents, employees and partners from and against all claims or suits and any damages or costs (including reasonable attorneys’ fees) arising from or relating to the Entrant’s violation or inaccuracy of any warrantees or representations made relating to this Contest. The Sponsor assumes no responsibility for errors that may occur in the transmission of Entrant’s Entry. 

x. The Sponsor is not responsible for any fraud or misconduct on the part of the Entrants. Should an Entrant engage in fraud or misconduct of any nature, including but not limited to a violation of the Contest Rules, such entrant shall be subject to immediate disqualification. The Sponsor reserves the right to terminate, modify or amend the Contest at any time if the fairness, integrity, and or proper administration of the Contest is jeopardized. In no event shall the Sponsor be liable to entrant for any lost profits, or for any special, incidental, consequential or other indirect damages arising out of or in connection with this contest. Entrant’s sole damages shall be limited to entrant’s actual out-of-pocket expenses, excluding attorneys’ fees.

y. In order to be eligible to win the Prize, the Entrant(s) must have correctly answered, without assistance or mechanical aid, a skill-testing question and otherwise comply with these Official Rules and Regulations. 

z. None of the Contest Entities, or their respective licensors, affiliates, associates, agents or representatives, or their respective directors, officers, agents, employees, affiliates and assigns (together with the Contest Entities, the “Relevant Persons”) shall be responsible in any way or bear any liability whatsoever in any way for any participation in this Contest or the awarding, acceptance, use, misuse, possession, loss or misdirection of any Prize, for any entries that are delayed, stolen, misdirected, lost, destroyed or damaged, for any failure or slowdown of programs or software supporting, connected to or related to this Contest, for any problems or technical malfunctions of any kind, however caused, for any inability of any winner to accept a Prize for any reason or for any claim or loss attributable to a Prize awarded in this Contest.  

aa. Failure to return the necessary documentation to the Sponsor by the date specified in the correspondence from the Sponsor may (in the Sponsor’s sole discretion) cause the Prize Winner to forfeit the respective Prize in its entirety. In such cases, it shall be in the Sponsor’s sole discretion whether to select another entrant as a Prize Winner, or not to award a Prize at all.

bb. None of the Contest Entities are responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to errors in advertising, these Official Rules and Regulations, the selection and announcement of Winner(s), or the distribution of a Prize.

5.  PRIVACY

cc. By entering this Contest, all Entrant(s) agree to the Sponsor’s use of 

Entrant(s) personal information for the purposes of Contest Winner selection. All entrants understand on entering the FOIPOP (Freedom of Information and Protection of Privacy Act) applies to all information associated with this contest.

6. These are the official Contest Rules. 

dd. This Contest is subject to all federal, provincial and municipal laws and regulations. The Sponsor reserves the right to amend the contest rules without prior notification.

7. RELEASE AND EXCLUSION OF LIABILITY: 

ee. By the Entrants:  By entering or attempting to enter the Contest, each Entrant and/or purported Entrant agrees: (i) to release, discharge, and forever hold harmless the Sponsors, and their respective officers, directors, employees, shareholders, agents and other representatives (collectively, the “Releasees”) from any and all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties, accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with the entrant’s participation or attempted participation in the contest, compliance or non-compliance with these contest rules and acceptance and use of the prize; and (ii) if selected as a potential Winner, to sign the Sponsor’s form(s) of declaration and release documentation in this regard before receiving his/her prize. The Releasees will not be responsible for lost, incomplete, late or misdirected entries or for any failure of the Contest website during the Contest Period, or for any technical malfunction or other problems, and will not be liable for any resulting injury or damage to any person or property arising from, or relating to, that person’s or any other person’s participation or attempted participation in the Contest. Any attempt to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

ff. Minors: Where the selected Entrant is under the age of majority in his/her province of residence, as a pre-condition to the selected Entrant being declared a Winner and receiving a prize, the parent or legal guardian of the minor (where applicable) must sign and return to the Sponsor the Sponsor’s form(s) of declaration and release documentation. 

gg. Name/Image of Winner(s): By entering the Contest, each Winner authorizes the Sponsor and its advertising and promotional agencies and their respective employees or other representatives to broadcast, publish and otherwise use his or her name, photograph, image, statements regarding the Contest or any prize, place of residence and (or) voice for publicity purposes, without any form of remuneration.

hh. Communication with Entrant(s): No communication or correspondence will be entered into with Entrant(s), other than with entrants who are selected as potential prize Winners. 

ii. Personal Information: The personal information gathered about Entrant(s) in connection with this Contest will be used solely for the administration of the Contest. All such information is subject to Federal, Provincial and Municipal laws and regulations. No communication unrelated to the Contest, commercial or otherwise, will be sent to the Entrant by Sponsor, unless the entrant has otherwise been requested to do so by the Sponsor or one of its affiliates, as the case may be, to do so.

jj. Identity of the Entrant: For the purposes of these rules, the Entrant is the names that appear on the Entry. It is to the workplace of the Entrant that the prize will be awarded, if selected and declared as the Winner.
